His order reversed former president Barack Obama\u2019s instructions to mainly detain and deport criminals and those who had recently crossed the border.<\/p>\n<div class=\"inline-newsletter \" data-exact-target-id=\"20427611\" data-mailing-list-name=\"Ground Game\" data-is-amp=\"\" data-section=\"\/news\/nation\">\n<div class=\"inline-newsletter__copy\">\n<div class=\"inline-newsletter__title\">Get\u00a0<span class=\"inline-newsletter__bold\">Ground Game<\/span>\u00a0in your inbox:<\/div>\n<div class=\"inline-newsletter__description\">Daily updates and analysis on national politics from James Pindell.<\/div>\n<\/div>\n<form class=\"inline-newsletter__content\" method=\"post\">\n<div class=\"inline-newsletter__error-text\"><\/div>\n<p><span style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">However officials cautioned that the new directive does not mean that all pregnant women will be detained. Cases will be handled on an individual basis, depending on the women\u2019s flight risk, medical condition, and whether they pose a danger to the public. Immigration officials also generally do not detain women in their third trimester.<\/span><\/form>\n<\/div>\n<p>\u2018\u2018We\u2019re ending the presumption of release for all pregnant detainees,\u2019\u2019 said Philip Miller, deputy executive associate director at ICE. \u2018\u2018We\u2019re no longer exempting any individual from being subject to the law.\u2019\u2019<\/p>\n<p>The policy quietly took effect in December, and Miller said he did not know if it has led to an increase in pregnant detainees.<\/p>\n<p>Since then, ICE has held 506 pregnant women in custody, but most are no longer detained. Miller said he did not know if they had been released or deported.<\/p>\n<p>As of March 20, about 35 pregnant women were in custody, subject to mandatory detention under the law.<\/p>\n<p>Advocates for immigrants swiftly rebuked the new policy, which comes months after the American Civil Liberties Union, the Women\u2019s Refugee Commission, and others filed a complaint with the Department of Homeland Security about the treatment of pregnant detainees. They said that ICE offered inadequate care and that the detention harmed women who had been raped or had high-risk pregnancies. Some miscarried.<\/p>\n<p>The National Immigrant Justice Center, a nonprofit that advocates for immigrants\u2019 rights, called the new policy \u2018\u2018little more than blanket prolonged detention for all immigrants.\u2019\u2019<\/p>\n<p>\u2018\u2018Again, ICE\u2019s policymaking tells us all we need to know about the administration\u2019s immigration-related goals \u2014 inflicting the maximum possible harm on already vulnerable individuals and communities, all in service of an explicitly anti-immigrant agenda,\u2019\u2019 Mary Meg McCarthy, the center\u2019s executive director, said in a statement.<\/p>\n<p>ICE officials said the agency provides prenatal care and education to pregnant detainees, as well as \u2018\u2018remote access\u2019\u2019 to specialists. The agency also \u2018\u2018ensures access to comprehensive counseling and assistance, postpartum follow-up, lactation services, and abortion services.\u2019\u2019<\/p>\n<p>Adult ICE detainees will continue to have access to abortion services in federal custody, according to agency records.<\/p>\n<p>Most pregnant women are detained after crossing the border illegally, Miller said, but some have committed crimes.<\/p>\n<p>The new policy opens a new chapter in the president\u2019s attempt to clamp down on illegal immigration, one of his signature issues on the campaign trail. Trump has aggressively peeled back Obama\u2019s protections for undocumented immigrants.<\/p>\n<p>He has phased out work permits for hundreds of thousands of undocumented immigrants, including Liberians this week.
