(Joshua Roberts\/Reuters)<\/div>\n<\/div>\n<p data-elm-loc=\"1\"><a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2018\/04\/10\/the-white-house-just-edged-closer-to-possibly-firing-robert-mueller\/?utm_term=.168fd7591e38\">The Post reports<\/a>:\u00a0\u201cDuring Tuesday\u2019s White House briefing, press secretary Sarah Huckabee Sanders was given an opportunity to talk about firing\u00a0[special counsel Robert S. Mueller III]. But rather than play down the prospect, she answered the question and asserted that [President] Trump could, in fact, fire Mueller if he wanted to.\u201d<\/p>\n<p data-elm-loc=\"2\">Her answer should create heartburn for Republicans in Congress who insist that there is no real risk Trump will dismiss Mueller, and therefore no need for lawmakers to act to restrain Trump. That excuse is\u00a0wearing thin.<\/p>\n<p data-elm-loc=\"3\">Even more frightening,\u00a0<a href=\"https:\/\/www.nytimes.com\/2018\/04\/10\/us\/politics\/trump-sought-to-fire-mueller-in-december.html\">the New York Times reports<\/a>\u00a0that Trump considered firing Mueller\u00a0at least twice \u2014 once in June and again in December. (Interestingly, his ire was reportedly triggered by a report that Mueller had subpoenaed records from Deutsche Bank. Trump seems particularly concerned whenever Mueller veers close to his financial affairs.)<\/p>\n<div id=\"fR93n51DG2yXMq\" class=\"moat-trackable pb-f-theme-normal pb-f-dehydrate-false pb-f-async-true pb-feature pb-layout-item pb-f-page-newsletter-inLine injected-by-front-end\" data-chain-name=\"no-name\" data-feature-name=\"no-name\" data-feature-id=\"page\/newsletter-inLine\" data-pb-fingerprint=\"0fDPb0gHHp9\">\n<div class=\" border-bottom- nl-top-hairline\">\n<div class=\"pb-subscribe pb-subscribe-promo pb-subscribe-newsletter pb-font-smoothing showSubscription\">\n<div class=\"pb-subscribe-button\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p data-elm-loc=\"4\">Moreover, Sanders\u2019s formulation is not consistent with what many members of Congress and outside legal experts have concluded. \u201cUnder the current regulations, he does not have the ability to personally fire Mueller, but the White House is right that if Trump wants to remove him, he eventually can,\u201d former Justice Department public affairs director Matt Miller tells me. \u201cBut he will have to burn down the Justice Department to do it, and one hopes such a hostile act to the rule of law would bring about the end of his presidency.\u201d<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.washingtonpost.com\/video\/c\/embed\/6b50c6d0-3cdb-11e8-955b-7d2e19b79966\" width=\"480\" height=\"290\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<\/article>\n<\/div>\n<div id=\"powa-6b50c6d0-3cdb-11e8-955b-7d2e19b79966-0-powa-pane\" class=\"powa-pane\">\n<div class=\"powa-shot-masthead\">\n<div class=\"powa-shot-title shadow franklin-light\"><\/div>\n<div class=\"powa-shot-sharing\">\n<div class=\"franklin-bold powa-shot-sharing-embed powa-shot-sharing-item\">\n<div>\u00a0<span class=\"powa-tease\" style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Post deputy editorial page editor Ruth Marcus has a lesson for the president about how to respond to news the FBI searched his personal attorney&#8217;s property.<\/span><span class=\"powa-byline franklin-light\" style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">(Gillian Brockell\/The Washington Post)<\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p data-elm-loc=\"6\">If Sanders meant that Trump could fire Mueller by going through Deputy Attorney General Rod J. Rosenstein, that raises two problems. If\u00a0Rosenstein resists, Trump would be forced to fire him, putting the entire investigation in jeopardy. More important, former federal prosecutor Joyce White Vance argues, \u201cThis isn\u2019t about whether he can, it\u2019s about whether he should.\u201d She explains that this is akin to\u00a0allowing \u201ca cartel that traffics drugs [to] fire a prosecutor that\u2019s investigating it.\u201d She continues: \u201cIf we have a different rule for the president, then we\u2019ve become a regime that turns a blind eye to corrupt leadership. No one is above the law, not even the president.\u201d<\/p>\n<p data-elm-loc=\"7\">Did Trump receive a legal opinion on this point, and if so, from whom? Perhaps the Senate or House judiciary committee should conduct a hearing on this.<\/p>\n<p data-elm-loc=\"8\">But this is more than an academic exercise. News reports suggest that Trump was\u00a0<a href=\"https:\/\/www.cnn.com\/2018\/04\/10\/politics\/trump-rod-rosenstein-robert-mueller\/index.html\">considering firing Rosenstein<\/a>\u00a0and is more unhinged \u2014 and furious with Mueller\u00a0\u2014 than ever.\u00a0<a href=\"https:\/\/www.cnn.com\/2018\/04\/09\/politics\/donald-trump-michael-cohen-anger-robert-mueller\/index.html\">As CNN put it<\/a>, \u201cHis boiling display in the White House Cabinet Room\u00a0on Monday evening only served to underscore the president\u2019s most visible weakness: his ambient rage over Robert Mueller\u2019s Russia investigation.\u201d His conduct may make some of his aides uncomfortable:<\/p>\n<blockquote class=\"citation blockquote\">\n<p data-elm-loc=\"9\">Defense Secretary James Mattis sat stone-faced across the table, his hands folded and his eyes cast downward. Bolton, sitting to Trump\u2019s left, adjusted his glasses and fiddled with his pen. Vice President Mike Pence, at Trump\u2019s right, stared ahead with an unchanging expression of concern.<\/p>\n<p data-elm-loc=\"9\">Other military leaders looked on silently as the commander in chief attacked his attorney general, deputy attorney general and special counsel in a blistering partisan attack that stood out even by Trump\u2019s standards.<\/p>\n<\/blockquote>\n<p data-elm-loc=\"10\">The president\u00a0lacks\u00a0anyone \u2014 a Hope Hicks, a family member or, at this point,\u00a0an empowered\u00a0chief of staff \u2014 who is both willing and able to constrain him. In the past, some advisers have refused to act on his orders. White House counsel Donald McGahn refused to fire the special counsel. FBI chief Christopher A.\u00a0 Wray for a time refused to fire then-deputy director Andrew McCabe.\u00a0But there is no guarantee that aides will continue to block Trump or that he won\u2019t decide to fire people himself rather than going through an intermediary.<\/p>\n<p data-elm-loc=\"11\">This is precisely why Congress must act to stave off a constitutional crisis. By refusing to do so, Congress is conveying, intentionally or not, its lack of determination to challenge Trump. One can imagine that if he were to fire Mueller, he\u2019d cite Congress\u2019s failure to act as a justification for his action. Rep.
