These students may also reasonably feel an additional and unwarranted burden to perform well, so that their performance not be used or misused by their professor in public discourse about racial inequality in academic success. More broadly, this dynamic may negatively affect the classroom experience for all students regardless of race or background.<\/p>\n<div class=\"teads-inread sm-screen\">\n<div><\/div>\n<\/div>\n<p>\u201cAfter consulting faculty, alumni\/ae, Overseers, and University officials, I have decided that Professor Wax will continue to teach elective courses in her areas of expertise, but that are outside of the mandatory first-year curriculum. This curricular decision entails no sanction or diminution of Professor Wax\u2019s status on the faculty, which remains secure. Normally, this decision would be private, but because Professor Wax made these inaccurate public statements, and students and alumni raised their concerns publicly, sharing it with our community is important.\u201d<\/p>\n<p>In the email, Ruger also addressed the substance of Wax\u2019s claims: \u201cIt is imperative for me as dean to state that these claims are false: black students have graduated in the top of the class at Penn Law, and the Law Review does not have a diversity mandate. Rather, its editors are selected based on a competitive process. And contrary to any suggestion otherwise, black students at Penn Law are extremely successful, both inside and outside the classroom, in the job market, and in their careers.\u201d<\/p>\n<p><strong>ORIGINAL:<\/strong>\u00a0Black students at the University of Pennsylvania\u2019s law school have denounced unsupported claims about their academic performance made by\u00a0<a href=\"https:\/\/www.phillymag.com\/news\/2017\/08\/11\/penn-amy-wax-op-ed\/\">controversial law professor Amy Wax<\/a>\u00a0in a September 2017 online interview that\u00a0<a href=\"https:\/\/abovethelaw.com\/2018\/03\/professor-declares-black-students-rarely-graduate-in-the-top-half-of-law-school-class\/\" target=\"_blank\" rel=\"noopener\">recently resurfaced<\/a>.<\/p>\n<p>\u201cI don\u2019t think I\u2019ve ever seen a black student graduate in the top quarter of the [Penn Law school] class and rarely, rarely in the top half,\u201d Wax says in the video, titled \u201cThe Downside to Social Uplift\u201d and hosted by Brown University professor Glenn Loury. \u201cI can think of one or two students who\u2019ve graduated in the top half of my required first-year course.\u201d<\/p>\n<p>Asked by Loury, who is Black, to explain further, Wax responds \u201cI haven\u2019t done a survey, I haven\u2019t done a systematic study\u201d and argues that because she teaches \u201c89 to 95 students\u201d a year, she is \u201cgoing on that because a lot of this data is a closely guarded secret, as you can imagine.\u201d<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/lgIHNV_7rm0?feature=oembed\" width=\"500\" height=\"281\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p>Penn\u2019s Black Law Students Association (BLSA) has\u00a0<a href=\"https:\/\/docs.google.com\/forms\/d\/e\/1FAIpQLSd_SCzQ04t3uiima8U-1ulEHmztArIiTkReUSeh2TNv8PqcYg\/viewform\" target=\"_blank\" rel=\"noopener noreferrer\">created a petition<\/a>\u00a0calling on law school dean Theodore Ruger to \u201cissue a strong, explicit response addressing and rebutting such deleterious and false claims\u201d made by Wax. The petition claims that Wax\u2019s comments \u201ccompromise\u201d\u00a0<a href=\"https:\/\/provost.upenn.edu\/policies\/faculty-handbook\/students\/iv-j\" target=\"_blank\" rel=\"noopener noreferrer\">the law school\u2019s grade confidentiality policy<\/a>\u00a0and also demands information from Ruger on whether the school collects data on Black students and what information Wax is basing her\u00a0remarks\u00a0on. The petition also seeks to have Wax removed from teaching first-year law students and stripped of any leadership role at the school.<\/p>\n<p>Students and academics have taken to social media to criticize Wax\u2019s remarks, with some describing her as a \u201cracist professor\u201d:<\/p>\n<p>https:\/\/twitter.com\/KharyTheCEO\/status\/972116781841207296<\/p>\n<p>\u201cI would emphasize that student performance is a matter of fact, not opinion. It is what it is,\u201d Wax said of her remarks in an\u00a0<a href=\"http:\/\/www.thedp.com\/article\/2018\/03\/amy-wax-petition-penn-law-students-black-african-american-upenn-philadelphia\" target=\"_blank\" rel=\"noopener noreferrer\">email quoted in\u00a0<em>The Daily Pennsylvanian<\/em><\/a>\u00a0on Sunday.<\/p>\n<p>Ruger and Penn Law associate dean and registrar Claire Wallace have not spoken on the matter publicly and did not respond to a request for comment. The University of Pennsylvania has not yet commented.<\/p>\n<p>\u201cAmy Wax insinuated demonstrably false and deeply offensive claims about black law students and alumni,\u201d Nick Hall, a third-year law student and president of BLSA, told\u00a0<em>Philadelphia<\/em>\u00a0magazine. \u201cIn the end, this story will not be about Amy Wax. She doesn\u2019t need any more of a platform. It will be about the resilience of black Penn Law students to rise against bigotry.\u201d<\/p>\n<p>Fellow Penn law professor\u00a0Tobias Barrington Wolff addressed\u00a0<a href=\"http:\/\/www.thefacultylounge.org\/2018\/03\/guest-post-by-tobias-barrington-wolff-the-provocateurs-toolbox.html\" target=\"_blank\" rel=\"noopener\">Wax\u2019s current and past controversies<\/a>\u00a0in a post on Sunday. \u201cStripped of the scornful language and sententious hand-waving,\u201d Wolff writes, \u201cProfessor Wax\u2019s argument amounts to this: White people as a group do better in society than many people of color because White people have better values; those values are the product of a superior Anglo-Protestant culture; and the problem with people of color is their failure or refusal to emulate White people and White values. \u2026 Professor Wax has used the privilege of her position to heap scorn on people who exhibit a dignity, courage, and perseverance she will likely never understand. Behavior like that deserves no more respect coming from a chaired and tenured professor than it does from a sensationalistic television pundit.\u201d<\/p>\n<\/div>\n<div
