One of the officers has resigned, and the police chief has offered to follow suit.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"141\" data-total-count=\"488\">\u201cThe city is in outrage,\u201d Councilwoman Sheneika Smith said in a phone interview on Wednesday. \u201cFacebook was flaming. It was on fire.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"269\" data-total-count=\"757\">The beginning of the video, which was taken last year, shows Johnnie Jermaine Rush being approached by Verino Ruggiero, an officer in training, shortly after midnight on Aug. 25 at a street corner near a baseball stadium in Asheville, about 120 miles west of Charlotte.<\/p>\n<p id=\"story-continues-1\" class=\"story-body-text story-content\" data-para-count=\"93\" data-total-count=\"850\">\u201cYou didn\u2019t use the crosswalk four times in a row,\u201d Officer Ruggiero says in the video.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"103\" data-total-count=\"953\">\u201cAll I\u2019m trying to do is go home, man. I\u2019m tired!\u201d Mr. Rush says. \u201cI just got off of work.\u201d<\/p>\n<p id=\"story-continues-3\" class=\"story-body-text story-content\" data-para-count=\"99\" data-total-count=\"1052\">\u201cI\u2019ve got two options, I can either arrest you or write you a ticket,\u201d Officer Ruggiero says.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"104\" data-total-count=\"1156\">\u201cIt doesn\u2019t matter, man. Do what you got to do besides keep harassing me, man,\u201d Mr. Rush responds.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"259\" data-total-count=\"1415\">The episode quickly escalates from there. Officer Chris Hickman, who was training Officer Ruggiero and wearing the body camera, orders Mr. Rush to put his hands behind his back. Mr. Rush runs, and the officers chase him, eventually tackling him to the ground.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"120\" data-total-count=\"1535\">During the arrest, Mr. Rush was shocked with a Taser, choked and beaten by Officer Hickman, according to police records.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"87\" data-total-count=\"1622\">At several points, while pinned to the ground, Mr. Rush cried, \u201cI can\u2019t breathe!\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"171\" data-total-count=\"1793\">The camera footage also shows Officer Hickman hitting Mr. Rush on the head over and over with a closed fist, and Mr. Rush crying out in pain as he is shocked with a Taser.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"42\" data-total-count=\"1835\">Mr. Rush could not be reached for comment.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"90\" data-total-count=\"1925\">When Councilwoman Smith first saw the video, she said she was \u201cimmediately disturbed.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"207\" data-total-count=\"2132\">She recognized Mr. Rush, she said, from her work last year with the nonprofit Green Opportunities, a work force development organization that provides training programs to people in marginalized communities.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"239\" data-total-count=\"2371\">She described him as a hardworking man who was eager to learn and who had expressed an interest in construction and carpentry. \u201cHe was looking for opportunities to gain more skills so he could qualify for higher-paying jobs,\u201d she said.<\/p>\n<p id=\"story-continues-4\" class=\"story-body-text story-content\" data-para-count=\"174\" data-total-count=\"2545\">On the day Mr. Rush was approached by the officers, he was walking home after the end of his dishwashing shift at a Cracker Barrel restaurant, according to the arrest report.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"307\" data-total-count=\"2852\">Police records show he was charged with second-degree trespass, impeding traffic, assault on a government official and resisting a public officer. In September, all of the charges were dismissed after Todd M. Williams, the district attorney in Asheville, reviewed the body camera video, police records show.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"62\" data-total-count=\"2914\">Mr. Williams did not respond to repeated requests for comment.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"196\" data-total-count=\"3110\">Late Wednesday, at a local police advisory meeting packed with community members, Police Chief Tammy Hooper\u00a0<a href=\"https:\/\/www.citizen-times.com\/story\/news\/local\/2018\/03\/07\/apd-chief-says-she-quit-if-necessary-over-beating-video\/405626002\/\">reportedly<\/a>\u00a0said she was \u201chappy to resign\u201d if that would quell the public discontent.<\/p>\n<article id=\"story\" class=\"story theme-main \">\n<div class=\"story-body-supplemental\">\n<div class=\"story-body story-body-2\">\n<p class=\"story-body-text story-content\" data-para-count=\"119\" data-total-count=\"3229\">In a statement last week, Chief Hooper apologized for the episode, calling the actions in the video \u201cunacceptable.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"180\" data-total-count=\"3409\">Chief Hooper directed all questions to an Asheville Police Department spokeswoman, who declined to respond, referring instead to the documents and statements already\u00a0<a href=\"http:\/\/coablog.ashevillenc.gov\/2018\/03\/asheville-apd-excessive-use-of-force-investigation-all-press-releases-graphics-and-documents-in-one-place\/\">posted online<\/a>.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"278\" data-total-count=\"3687\">\u201cThe whole thing is bad, right?\u201d Chief Hooper said in a\u00a0<a href=\"http:\/\/wlos.com\/news\/local\/asheville-police-chief-hooper-calls-officers-actions-in-video-bad-from-start-to-finish\">long-ranging interview with the television station WLOS<\/a>\u00a0that was posted on Monday. \u201cIt\u2019s just a terrible, egregious case. The whole reason around the stop to begin with was just a bad thing from start to finish.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"100\" data-total-count=\"3787\">She also told WLOS that the Police Department was rethinking its protocol for excessive force cases.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"298\" data-total-count=\"4085\">The two administrative investigations of Officer Hickman, which concluded in December, took several months. It was not until January that the criminal investigation began, the results of which are expected to be given to the district attorney next week. Officer Ruggiero is not under investigation.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"436\" data-total-count=\"4521\">The administrative investigations revealed that Officer Hickman had used excessive force during the arrest and that he had engaged in \u201crude and discourteous behavior\u201d on four other occasions with other members of the public, according to police records. Chief Hooper decided to terminate him in January, personnel records show, but before she could deliver the news, he notified the department of his resignation, the documents say.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"157\" data-total-count=\"4678\">On Wednesday,\u00a0<a href=\"https:\/\/mobile.nytimes.com\/aponline\/2018\/03\/07\/us\/ap-us-officer-jaywalker-beaten.html\">The Associated Press<\/a>\u00a0reported that the Federal Bureau of Investigation had opened a criminal investigation into the actions of Officer Hickman.<\/p>\n<p id=\"story-continues-5\" class=\"story-body-text story-content\" data-para-count=\"49\" data-total-count=\"4727\">Officer Hickman could not be reached for comment.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"288\" data-total-count=\"5015\">A supervisor who responded to the scene on the night of Mr. Rush\u2019s arrest was disciplined for unsatisfactory performance after failing to immediately disclose all of the details gleaned from interviewing Mr. Hickman and Mr. Rush, and neglecting to view the body camera footage that day.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"88\" data-total-count=\"5103\">Mr. Rush\u00a0<a href=\"https:\/\/www.citizen-times.com\/story\/news\/local\/2018\/03\/07\/asheville-police-beating-victimpolice-calasheville-police-beating-victim-says-officer-accused-him-ly\/399262002\/\">told The Citizen Times<\/a>\u00a0that the supervisor accused him multiple times of lying.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"129\" data-total-count=\"5232\">\u201cShe kind of yelled a little bit, saying: \u2018You\u2019re lying. You\u2019re lying. My officer is not going to do that,\u2019\u201d he said.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"226\" data-total-count=\"5458\">The City of Asheville has filed a petition requesting that the Police Department release additional body camera footage from the night of Mr. Rush\u2019s arrest to provide the public with a \u201ccomplete picture of the incident.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"161\" data-total-count=\"5619\">Asheville, a city of nearly 90,000 in the Appalachian Mountains, is deeply segregated, Councilwoman Smith said. Only about 12 percent of the population is black.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"159\" data-total-count=\"5778\">Last year, Chief Hooper\u00a0<a href=\"http:\/\/wlos.com\/news\/local\/group-opposes-1m-budget-increase-for-asheville-police-department\">faced protests<\/a>\u00a0after requesting $1 million to\u00a0<a href=\"http:\/\/wlos.com\/news\/local\/asheville-police-chief-wants-24-7-policing-of-downtown-area\">hire more officers<\/a>\u00a0to police the downtown area, which is near where Mr. Rush was tackled.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"219\" data-total-count=\"5997\">\u201cAsheville has an issue where we place value on certain people and we devalue other people based on their race, their politics, their economic situation or their placement within Asheville,\u201d Councilwoman Smith said.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"102\" data-total-count=\"6099\">In a statement, the mayor of Asheville, Esther E. Manheimer, called the video \u201chighly disturbing.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"105\" data-total-count=\"6204\">\u201cWe are better than this.
