Jerry Brown was named in a lawsuit that seeks to block three California laws that may hinder the federal immigration agenda.<\/span>\u00a0<span class=\"credit\"><span class=\"visually-hidden\">Credit<\/span>Jim Wilson\/The New York Times<\/span><\/h6>\n<p class=\"story-body-text story-content\" data-para-count=\"242\" data-total-count=\"242\">WASHINGTON \u2014 The Trump administration escalated what had been a war of words over California\u2019s immigration agenda, filing a lawsuit late Tuesday that amounted to a pre-emptive strike against the liberal state\u2019s so-called sanctuary laws.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"389\" data-total-count=\"631\">The Justice Department sued California; Gov. Jerry Brown; and the state\u2019s attorney general, Xavier Becerra, over three state laws passed in recent months, saying they made it impossible for federal immigration officials to do their jobs and deport criminals who were born outside the United States. The Justice Department called the laws unconstitutional and asked a judge to block them.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"340\" data-total-count=\"971\">The lawsuit was the department\u2019s boldest attack yet against California, one of\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/01\/18\/us\/california-strikes-a-bold-pose-as-vanguard-of-the-resistance.html\">the strongest opponents<\/a>\u00a0of the Trump administration\u2019s efforts to curb immigration. It also served as a warning to Democratic lawmakers and elected officials nationwide who have enacted sanctuary policies that provide protections for undocumented immigrants.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"335\" data-total-count=\"1306\">\u201cThe Department of Justice and the Trump administration are going to fight these unjust, unfair and unconstitutional policies that have been imposed on you,\u201d Attorney General Jeff Sessions planned to say on Wednesday at a law enforcement event in Sacramento, according to prepared remarks. \u201cI believe that we are going to win.\u201d<\/p>\n<p id=\"story-continues-1\" class=\"story-body-text story-content\" data-para-count=\"285\" data-total-count=\"1591\">The battle pits President Trump and Mr. Sessions, immigration hard-liners, against Mr. Brown and Mr. Becerra, who have emerged as<a href=\"https:\/\/www.nytimes.com\/2018\/01\/07\/us\/california-sanctuary-marijuana.html\">outspoken adversaries<\/a>\u00a0who have helped energize opposition to Mr. Trump and vowed to preserve the progressive values that they believe California embodies.<\/p>\n<div id=\"story-meta-footer\" class=\"story-meta-footer\">\n<div class=\"story-meta-footer-sharetools\">\n<p id=\"story-continues-3\" class=\"story-body-text story-content\" data-para-count=\"358\" data-total-count=\"1949\">The lawsuit claims that the statutes \u201creflect a deliberate effort by California to obstruct the United States\u2019 enforcement of federal immigration law.\u201d It also says the laws regulate private entities that want to cooperate with the federal authorities and \u201cimpede consultation and communication between federal and state law enforcement officials.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"53\" data-total-count=\"2002\">Mr. Brown called the lawsuit a \u201cpolitical stunt.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"260\" data-total-count=\"2262\">\u201cAt a time of unprecedented political turmoil, Jeff Sessions has come to California to further divide and polarize America,\u201d Mr. Brown said in a statement. \u201cJeff, these political stunts may be the norm in Washington, but they don\u2019t work here. SAD!!!\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"355\" data-total-count=\"2617\">California began battling the Trump administration even before Mr. Trump took office, standing in opposition on a number of issues, including marijuana, environmental regulations and taxes. But immigration has proved to be the most contentious fight, with local officials assuring undocumented immigrants that they would do all they could to protect them.<\/p>\n<figure id=\"document-justice-lawsuit-california\" class=\"interactive promo layout-small\">\n<div class=\"interactive-image-container\">\n<div class=\"interactive-image\"><a href=\"https:\/\/www.nytimes.com\/interactive\/2018\/03\/06\/us\/politics\/document-justice-lawsuit-california.html\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"https:\/\/i0.wp.com\/static01.nyt.com\/images\/2018\/03\/06\/us\/politics\/image-justice-lawsuit-california\/image-justice-lawsuit-california-master180.gif?resize=180%2C233&#038;ssl=1\" alt=\"\" width=\"180\" height=\"233\" \/><\/a><\/div>\n<div class=\"interactive-overlay\"><\/div>\n<\/div>\n<h2 class=\"interactive-headline\">Document: Justice Dept.&#8217;s Suit Against California<\/h2>\n<\/figure>\n<p class=\"story-body-text story-content\" data-para-count=\"160\" data-total-count=\"2777\">Last year, California enacted the sanctuary laws, which restrict when and how local law enforcement can cooperate with federal immigration enforcement officers.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"245\" data-total-count=\"3022\">Both Mr. Sessions and Mr. Trump have threatened to pull federal grant money from\u00a0<a href=\"https:\/\/www.nytimes.com\/2017\/07\/26\/us\/politics\/sessions-sanctuary-cities.html\">cities and states<\/a>that have sanctuary laws to protect undocumented immigrants. They argue that the policies flout federal laws and help criminals evade deportation.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"318\" data-total-count=\"3340\">And the Justice Department\u00a0<a href=\"https:\/\/www.nytimes.com\/2018\/01\/24\/us\/politics\/sanctuary-cities-justice-department.html\">asked 23 jurisdictions<\/a>across the country this year to provide documentation that they had not kept information from federal immigration authorities, or receive a subpoena for the information. It is also\u00a0<a href=\"https:\/\/www.nytimes.com\/2018\/01\/18\/us\/politics\/justice-department-sanctuary-cities-criminal-charges-elected-offiicals.html\">exploring possible criminal charges<\/a>\u00a0for local politicians who enact sanctuary policies.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"587\" data-total-count=\"3927\">The lawsuit filed on Tuesday evening in Federal District Court in Sacramento is the first against a local or state government over its immigration policies filed by the Justice Department under Mr. Sessions. Department officials said that they would not rule out the possibility of other lawsuits against local governments whose policies interfere with the federal government\u2019s authority on immigration. Colorado, Illinois, New Mexico, Oregon and Vermont have state sanctuary laws, as do cities and counties in more than a dozen states, according to the Center for Immigration Studies.<\/p>\n<p id=\"story-continues-4\" class=\"story-body-text story-content\" data-para-count=\"350\" data-total-count=\"4277\">One, the California Values Act, strictly limits state and local agencies from sharing information with federal officers about criminals or suspects unless they have been convicted of serious crimes. The law, which took effect Jan. 1, was the centerpiece of the State Legislature\u2019s effort to thwart the Trump administration\u2019s immigration policies.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"271\" data-total-count=\"4548\">Soon after the law was enacted, Thomas D. Homan, the acting director of United States Immigration and Customs Enforcement, said that the state should expect to see \u201ca lot more deportation officers\u201d and that elected officials who support the policy should be arrested.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"253\" data-total-count=\"4801\">\u201cWe\u2019ve got to start charging some of these politicians with crimes,\u201d he said. \u201cThese politicians can\u2019t make these decisions and be held unaccountable for people dying. I mean, we need to hold these politicians accountable for their actions.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"180\" data-total-count=\"4981\">Mr. Homan and three other immigration and border protection officials filed declarations with the suit claiming that California\u2019s laws had already negatively affected their work.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"365\" data-total-count=\"5346\">\u201cThe administration is just angry that a state has stood up to them \u2014 one that embraces diversity and inclusivity and is the sixth-largest economy in the world thanks to the hard-working immigrants who want to become American citizens,\u201d said Kevin de Le\u00f3n, the leader of the California State Senate who wrote one of the sanctuary city laws named in the suit.<\/p>\n<div id=\"newsletter-promo\" class=\"newsletter-signup variant-1-hidden \" data-newsletter-productcode=\"NN\" data-newsletter-producttitle=\"Morning Briefing\" aria-labeledby=\"newsletter-promo-heading\">\n<p class=\"story-body-text story-content\" data-para-count=\"283\" data-total-count=\"5629\">State lawmakers also passed the\u00a0<a href=\"https:\/\/oag.ca.gov\/sites\/all\/files\/agweb\/pdfs\/immigrants\/immigration-ab450.pdf\">Immigrant Worker Protection Act<\/a>, which prohibits local business from allowing immigration to gain access to employee records without a court order or subpoena. Mr. Becerra warned that anyone who violated the new law would face a fine of up to $10,000.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"208\" data-total-count=\"5837\">In the state budget bill, California lawmakers prohibited new contracts for immigration detention in the state and gave the state attorney general the power to monitor all state immigration detention centers.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"187\" data-total-count=\"6024\">The state and several local governments including the cities of San Francisco and Sacramento have also set up legal defense funds to help defend immigrants during deportation proceedings.<\/p>\n<p id=\"story-continues-5\" class=\"story-body-text story-content\" data-para-count=\"342\" data-total-count=\"6366\">\u201cI\u2019m worried about the \u2018Dreamers,\u2019 hard-working immigrant families and law-abiding people who are just trying to make their way like the rest of us,\u201d Mayor Darrell Steinberg of Sacramento said this year when asked about the state\u2019s sanctuary legislation. \u201cCivil disobedience is a respectful way to show your love for country.\u201d<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"489\" data-total-count=\"6855\">Tensions between local and federal officials reached yet another height last week, when Mayor Libby Schaaf of Oakland\u00a0<a href=\"https:\/\/www.nytimes.com\/2018\/02\/28\/us\/oakland-mayor-ice-warning.html\">publicly warned<\/a>\u00a0of coming large-scale immigration arrest operations. Mr. Homan compared the mayor to a \u201cgang lookout yelling, \u201cPolice!\u201d and said she gave people living in the United States illegally a chance to flee. He said her warning meant that the federal immigration authorities arrested about 200 people rather than the 1,000 they had anticipated rounding up.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"369\" data-total-count=\"7224\">Although Mr. Homan and other federal officials have warned about targeting California as it steps up immigration enforcement efforts, the number of people arrested has not drastically increased so far. In December, the most recent month for which data is available, 1,715 unauthorized immigrants in California were arrested by ICE, compared with 1,379 in December 2016.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"347\" data-total-count=\"7571\">This is not the first time that the Justice Department has sued a state. During the Obama administration, the department filed a\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-sues-georgia-unnecessarily-segregating-students-disabilities\">civil rights lawsuit against Georgia<\/a>\u00a0for segregating students with disabilities from classrooms and\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-files-complaint-against-state-north-carolina-stop-discrimination-against\">sued North Carolina<\/a>\u00a0over a bill to restrict bathroom use for transgender citizens. Mr. Sessions withdrew that lawsuit.<\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"169\" data-total-count=\"7740\">In a call with reporters on Tuesday night, Mr. Becerra said that he was confident California would prevail in court and that state and federal laws were not in conflict.<\/p>\n<p><button class=\"button comments-button theme-speech-bubble-large\" data-skip-to-para-id=\"\"><i class=\"icon\"><span class=\"button-text\"><span class=\"count\">854<\/span><span class=\"units\">COMMENTS<\/span><\/span><\/i><\/button><\/p>\n<p class=\"story-body-text story-content\" data-para-count=\"286\" data-total-count=\"8026\">\u201cIn California, our state laws work in concert with federal law,\u201d he said. \u201cOur teams work together to go after drug dealers and go after gang violence. What we won\u2019t do is change from being focused on public safety.
